Section 79. If any person empowered to distrain property, or employed for the purpose under a written authority

79. If any person empowered to distrain property, or employed for the purpose under a written authority by a person so empowered, distrains or sells any property for the recovery of an arrear of rent alleged to be due, otherwise than according to the provisions of this Act, or if any distrained property is lost, damaged or destroyed, by reason of the distrainer not having taken proper precaution for the due keeping and preservation thereof, or if the distress is not immediately withdrawn when any provision of this Act requires such withdrawal— the owner of the property may institute a suit to recover compensation for any injury which he has thereby sustained. 80.
