On receiving such application, the Court shall issue a written notice to the other party to attend on the date and at the place specified in the notice, and shall depute an officer before whom the division, estimate or appraisement shall be made. The award of such officer in respect of such division, estimate or appraisement shall be final, unless within one month from the date thereof either party institutes a suit to set it aside.
