59. If the person arrested appears, from the informatioil obtained, to have - committed the offence charged, and the ofience is not Enquiry by the Police. bailable, the Officer in charge of the Police Station shall forward him under custody to the Magistrate having jurisdiction in respect of the offence, and shall bind over the prosecutbr ancl witnesses to appear on a fixed day before such Magistrate. TTThen any subordinate Police Officer has made any enq11i1.y 11nder this Act, he inay be required by the Officer in charge of the Police Station to submit a report of such enquiry to him, or he may do so mithout such instruction, and the Officer in charge of the Police Station shall then proceed as if he had made the enquiry himself.
